1. Acceptance of Terms

By downloading, installing, or using TamagoFit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and TamagoFit ("we," "our," or "us").

2. Description of Service

TamagoFit is a fitness gamification application that allows users to raise virtual pets ("Monsters") by engaging in real-world health activities. The App integrates with Apple HealthKit to read your fitness and health data (with your permission) and translates that data into in-game progress for your virtual pet, including experience points, hunger and sleep stats, and level progression.

The App includes features such as:

Virtual pet raising and evolution
HealthKit integration for step tracking, calorie monitoring, and sleep analysis
In-game shop with virtual items purchasable with in-game currency (coins)
Achievement and streak systems
In-app purchases for additional coins
Push notifications for pet status and reminders

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account and use TamagoFit. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

4. Account Registration

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Apple HealthKit Integration

TamagoFit requests access to read health data from Apple HealthKit. This access is entirely optional and requires your explicit consent through the iOS Health permissions dialog.

You may grant or revoke HealthKit permissions at any time through your device's Settings.
Revoking HealthKit access will prevent the App from syncing new health data to your virtual pet. Your pet and progress will be preserved, but stats will no longer update based on your physical activity.
HealthKit data is used solely to power in-app features (pet stats, achievements, streaks). It is never used for advertising, marketing, or shared with third parties.
TamagoFit does not write data to HealthKit.

Apple HealthKit Disclaimer: TamagoFit is not a medical device and does not provide medical advice. The health data displayed in the App is for informational and entertainment purposes only. Always consult a healthcare professional before making decisions about your health or fitness routine.

6. In-App Purchases

6.1 Virtual Currency

TamagoFit offers in-game coins that can be earned through gameplay or purchased with real money via in-app purchases. Coins can be used to buy virtual items (food, tea, candy) in the in-game shop. Coins have no real-world monetary value and cannot be exchanged for real currency or transferred to other users.

6.2 Payment Processing

All in-app purchases are processed through the Apple App Store or Google Play Store. By making a purchase, you agree to the respective store's terms of service and payment policies. We do not have access to your payment card information.

6.3 Refunds

Refund requests for in-app purchases must be directed to the Apple App Store or Google Play Store, as they handle all payment processing. We do not process refunds directly. All virtual items and currency are non-transferable and non-refundable, except as required by applicable law.

7. Virtual Pets and Game Mechanics

Virtual pets ("Monsters") exist only within the App and have no real-world value.
Pet stats (hunger, sleep) decrease over time. Neglecting your pet may result in its virtual "death." Pets can be revived using in-game coins.
We reserve the right to modify game mechanics, stats, items, and balancing at any time to improve the gameplay experience.
We do not guarantee the preservation of game progress in the event of technical issues, account deletion, or service discontinuation.

8. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to manipulate, hack, or exploit the App, its servers, or its game mechanics
Use automated systems, scripts, or bots to interact with the App
Attempt to spoof or falsify health data to gain an unfair in-game advantage
Reverse-engineer, decompile, or disassemble any part of the App
Interfere with or disrupt the App or its infrastructure
Create multiple accounts for the purpose of abusing promotions or game mechanics

We reserve the right to suspend or terminate your account if you violate these terms.

9. Intellectual Property

All content in the App, including but not limited to 3D models, animations, artwork, text, logos, sounds, and game mechanics, is the property of TamagoFit or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

10. Push Notifications

TamagoFit may send push notifications to remind you about your pet's status, achievements, or other in-app events. You can opt in or out of push notifications at any time through your device settings. We will not use push notifications for third-party advertising.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any health data displayed in the App. Health data is sourced from Apple HealthKit and its accuracy depends on your device's sensors and configuration.

TamagoFit is not a medical application. It is a gamification tool designed for entertainment and motivation. It should not be used as a substitute for professional medical advice, diagnosis, or treatment.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAMAGOFIT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use of or inability to use the App
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or other harmful code that may be transmitted through the App
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App
The loss of any virtual pets, items, currency, or game progress

13. Indemnification

You agree to defend, indemnify, and hold harmless TamagoFit and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may terminate or suspend your account at any time for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease, and any data associated with your account may be deleted.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in France.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by posting the revised Terms in the App or by email. Your continued use of the App after any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the App and delete your account.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid, enforceable provision that most closely matches the intent of the original provision.
